Polyphonic Ringtones: Calls, Court Cases, and Copyrights
Ringtones are big business. The Yankee Group announced that over the last five years, these musical tones have sent people literally singing to the bank, with a total revenue of $2 billion since 2001, and $50 million in one year alone.
The figures show how popular ringtones have become among cell phone users, who download the files to personalize their caller functions. They can pick from millions of songs, from the latest hit R&B single, to quirky sounds like cows mooing, to the classical pieces of Ludwig van Beethoven. Technological development has also made the audio quality of the ringtones much more realistic. From the ear-piercing, tin-like sounds of the first downloadable tunes, todays music pieces have a near-radio quality. You could dance to it, except youd look pretty silly shaking your booty while taking a call.
Unfortunately, the realistic quality of the musical pieces have raised a few ethical issues, namely violation of copyright. Since the sound of the ringtones and the sound of the actual songs are so close, record companies are saying that they count as reproductionsand because of that, they should pay some kind of royalty to the labels and the singers.
In a celebrated case, rap artist Eminem filed injunctions against five ringtone companies, supposedly because they had used his songs without his prior consent.
Some would argue that the ringtones only use ten seconds, maximum, of the actual song. How long should a snippet be before it becomes copyright infringement? Nokia representative Matthew Courtney believes that it has nothing to do with length. "Every reproduction of a musical excerpt involves payment of copyright fees to the copyright owner," he says.
There are some songs that fall beyond this rule, such as those that fall into public domain: classical pieces, national anthems, and yes, a cow mooing. (To date, there are no records of cows suing any major ringtone company.) Others still require the permission of the artists, and may even be subject to royalty fees.
Luckily most artists are not that inclined to sue, seeing the ringtones as a way of promoting their music, and perhaps a compliment to their own popularity. In a way, being immortalized in a ringtone has become a gauge of how ones music has infiltrated public consciousness. Besides, nobody actually downloads a ringtone as a replacement for an actual record. A real fan would want more than a ten second recording out of a three minute song, although would probably use that snippet to announce to the world, Hey, this tune rocks.
However, trends do indicate that fans may actually be willing to pay for their polyphonic ringtones. Music label EMI representative Jay Samit estimates that the earnings form ringtones could contribute as much as 10% of the record industrys total revenues. Apparently, the appeal of ringtones is that strong people arent just downloading it because its free, but because its a valued feature.
Of course, many polyphonic ringtones still allow people to download the tunes for free, generating their revenue from ads instead. Others use a mixture of the two business models, offering some for free (or a weekly rotating list) while requiring a small download fee for premium ringtones.
Either way, lawsuits notwithstanding, the fact is that ringtones are here to stay.

Learning jazz guitar can be intimidating and overwhelming for a beginning student. Unlike styles like rock, blues, and classical, jazz guitar demands that a musician master a wide variety of skills, including jazz guitar scales.
If you are absolutely fresh on jazz guitar, the first thing you've got to wrap your fingers around is the major scale and its modes. It's the reference against which all other scales are defined. Learn them in position as well as up and down single strings. It's also cool to practice them in one, two, and three octaves.
Once you've got those under your fingers and in your ears, it's time to start learning the melodic minor scale on guitar. The difference between a melodic minor scale and a major scale is only one note, the flat third. The melodic minor scale also has some really cool sounding modes, like lydian dominant which works over a 7#11 chord.
It's also important to learn your pentatonic scales. Most guitarists coming from a rock, blues, or country background are already familiar with the minor and major pentatonic scales, and if you aren't you have to check them out. The blues scale is also useful.
A common trap that students of jazz guitar fall into is only practicing scales up and down. Of course, it's important and is the first step to mastering jazz guitar scales. But if you're at a point where it's comfortable to play ascending and descending scales and you feel comfortable with the notes, the next step is to start practicing intervals and sequences. Also, try to vary the rhythm in your scale practice.

He was given an acoustic guitar when he was fourteen, and learnt to play it by ear. While he learnt and experimented with the guitar he discovered the technique of sitting the guitar in his lap and tapping, the strings and body to produce music. Paco de Lucia introduced the world to a new brand of flamenco in the 1970's and paved the way for a new generation of flamenco guitarists who were inspired by his passion for oriental scales and jazz influences. Entre Dos Aguas was an improvisation begun during a recording session because the LP Paco and his accompanying musicians were working on was short on material. The resulting rumba was a worldwide hit and established Paco as a force to be reckoned with well outside the boundaries of Spanish folk music. Paco sponsors his own line of flamenco guitars.
Back in the 1990's MTV decided to coax guitar hero Eric Clapton into playing some songs without the adornments provided by an electric guitar and amp. The resulting album won Grammy awards, gave Clapton's career a shot in the arm and reinvented the song Layla as an acoustic showpiece. The solo on Layla is far removed from the original theme conceived by Duane Allman which made the song a rock anthem.
In the late 1960's Mason Williams surprised himself by writing and performing an acoustic guitar solo which became a hit and remained popular for the decades since. The tune was called Classical Gas, and is striking for its simplicity and popular appeal. Classical Gas was born in an era when instrumentals such as The Lonely Surfer, A Walk In The Black Forest and Love Is Blue were standout hits for musicians who were otherwise unknown. But only Classical Gas retains the ability to make people sit up and listen.
So if you play the acoustic guitar a little and would like to learn how to play solos, you can use the world wide web to learn more about soloing techniques for acoustic guitar. The Chihuahua reached its peak in 1964 and became the third most popular breed in the United States. About a century after its discovery, the Chihuahua became one of the most recognizable breeds. The AKC now registered an average of 40,000 Chihuahuas each year. Both long and short haired Chihuahuas are popular as lap dogs around the world.
For many people Chihuahua is the only dog for them. However, Chihuahuas are not for everyone. Chihuahuas can be quite challenging.
Size of the Chihuahua
For many people the size of a dog is most important. The Chihuahuas small size makes it convenient for matters such as space, food bills, grooming and exercise.
