Terms & Conditions Part One.

Having a terms and conditions on you website when you are operating online are vitally important. It cannot be emphasized enough that you require legal protection.

What are Terms & Conditions then?

The word term comes from the Old French terme meaning limit which came from the Latin terminus or end. A simple definition from the Oxford English Dictionary is: stipulations made; conditions offered or accepted.

The word condition originates from the Latin com - together and dicere - say. A simple definition from the same Dictionary is: something required as part of an agreement.

So one could say that terms & conditions:

Are perimeters or boundaries and requirements agreed upon and within which all transactions between two or more parties must take place for an agreed upon result to occur and without which no transactions take place.

In short it is your armour to ensure you are not taken by surprise in the rear!

A proper and legal agreement is required that sets out the terms & conditions of any proposed transaction or sale and the consequences of it. Therefore this is an area where you would do well to consult with your legal representative in order to draw up a set of terms and conditions for your particular circumstances. I have seen many web sites with no or skimpy terms and conditions that leave the merchant wide open to legal action which may be quite unwarranted but can cripple the merchants business. Ask yourself, why do all the larger companies have such an extensive and involved terms and conditions? Take a look at Microsoft or Procter & Gamble or any of the larger corporations. You will not find lip service paid to terms and conditions. You will see a page maybe two or more of legal terms and conditions. If you study the larger corporations well you will see they are protected with legal iron clad armour surrounding them on all sides including their backside.

Your terms and conditions should reflect your policy as relates to fraud as well as privacy and complaints and the client or customer should be acknowledging and agreeing to the terms and conditions prior to any sale taking place.

80s dance music

THIS IS THE MODERN WORLD: Videos By Radiohead / Pink Floyd / Coldplay / Liz Phair / Starsailor / and More.

Sure, "art for art's sake" is cool... but what if you're pursuing a career as a
songwriter? This article is full of suggestions for how you can tailor your songs to
suit the requirements of music business professionals.

Many of us bemoan the state of commercial music today, but what are you doing to
improve things in your own microcosmic corner of the universe? Are you working to
create the next wave of great material songs that have a lifespan of more than a
few weeks or months? How can you use your talents to actually make a powerful
contribution... and make a living while you're at it?

The first step is to take a good look inside and explore what you as a unique
individual have to say, lyrically and musically. What do you think about, believe in,
stand for? What makes you tick? These precious truths that bubble up from the soul
provide the driving force behind great songwriting. These sparks of inspiration,
these "aha! moments," are what listeners crave when they play a song. They're also
what People Behind Desks are desparate to find. Do you have the courage to lay
bare your personal truth in public? I firmly believe that's what it takes to achieve
success with your songs.

The cynical among us will say, "no, you just need the right equipment, a catchy
hook and a whole lot of money behind you." Sure, those things help, but if you're
trying to break into the business, your song has to simultaneously grab people by
the guts, tickle their ears, and slam them over the head like a 2-by-4. Strive to write
songs that take risks, tap into the universal via the personal, and motivate people to
laugh, cry, feel, dance or take action. Make an effort to innovate, not imitate what's
already out there. In other words, write your passion. Songs miraculously translate
to listeners the exact emotion you felt while you were writing them. Do your best to
work that magic!

Another quality that professionals look for in a song is strong dynamic flow. Skillful
use of the many conventions of songwriting can manipulate listeners in the most
enjoyable way. Don't be afraid to push those emotional buttons! Here are some
ways to go about it:

Suck listeners in with lyrical, melodic and chordal tension.

Create a question in their minds: how will this turn out in the end?

Throw their bodies off balance with chords or melodies that are unexpected or
quirky.

Take a strong point of view that's boldly provocative, unique or intensely
felt.

Paint a vivid picture in the mind's eye.

Set a palpable mood.

Construct an entire sonic and/or lyrical environment.

Once you have piqued people's interest, crank up their involvement using all the
techniques in your lyrical toolbox, i.e. rhyme, meter, imagery, metaphor,
alliteration... you name it. Avoid clichs like the plague, or turn them on their heads
somehow. Experiment until you find the melody lines that best show off your lyrics,
and vice versa. Salt your song with enough repetition to make it memorable, but not
so much that it becomes predictable. Use chord progressions that are fresh,
stimulating the ear rather than lulling it into complacency.

When it comes time for the ultimate payoff, your Hook, don't settle! This is your
Money Shot, and most music biz pros will hit the "eject" button if they don't hear a
strong hook in one listen. One listen! Here are a few ways to enhance your hook:

Construct your song so that all roads, lyrically and melodically, lead to your
hook.

Remember that famous music business adage: "Don't bore us, get to the
chorus."

More hooks is merrier! Instrumental riffs, backups, rhythmical chord movement,
and verse melodies can provide secondary hooks.

Fear not repetition (up to a point, of course).

Throw in memorable "monkey wrench" words that stand out.

Make sure the world can sing along.

Play with the language: use slang, twists of phrase, even invent a new word!

Finally, People Behind Desks really appreciate it if you know your marketplace. Don't
submit a country ballad when their artist is a heavy metal guitar-shredder. And if
you're the performer, have at least 3 crowd-pleasing, radio-ready songs in hand
before you shop a deal. Make a detailed study of the hits in your chosen genres, and
incorporate those lessons into your work. The Internet has made it incredibly easy
to educate yourself about what's selling these days, so there's no excuse for
ignorance.

Look at the world for a moment from the perspective of a music industry pro: They'll
respond positively if they think your song will save their job. By bringing them
dynamic, single-worthy, heartfelt material you'll be well on your way to doing just
that, and creating a career for yourself as well.

Happy songwriting!

Latin American Music and Dance form a big part of Latin American culture. The ones that have got us Kiwis excited the most are Salsa, Merengue and Tango. Most Latin bands play a mixture of Salsa and Merengue when performing at Latin clubs around New Zealand. Tango seems to take a back seat and evenings usually start with Tango before the bands arrive. You will also find a bit of Cha Cha happening at the clubs, with the most popular song being "Let's Get Loud"! Most cities in New Zealand have adopted these dances as their own with training institutes and Latin clubs emerging everywhere. On the other hand, at the events you will also see a bit of Rueda with anything from 10 to 50 dancers in the circle.

As the population of dancers taking up Latin Americal dancing is increasing, other variations such as Mambo, Bachata, Cumbia, Rumba. Every now and then, there is an event that has a Bateria followed by Samba all round. Most Brazilian events in Wellington are organised by the guys at Wellington Batucada.

Having said that, Salsa is still the crowd pleaser. Cuban Style Salsa is more popular in New Zealand clubs, although Linear style is gaining in popularity. However, the best dancers seem to save their Linear moves for competitions and performances. With more and more Kiwi dancers getting into in, it shouldn't be long before we start seeing council organised events meant for hundreds of dancers. The new Waitangi Park in Wellington would be a perfect location for a community event of this kind.

So you love music and you want to be a DJ. Well before
taking the plunge there are some things you need to
know about how to become a DJ.

Since there is no such thing as a DJ school to teach
you the steps one of the first things you need to know
is that you need to be original and if possible new in
your talent and technique. Talk to other DJ's if you can
and find out how they broke into the business and get
some tips from them. See if they will take you on as an
apprentice so that you can learn.

A person that aspires to be a disk jockey needs to have
a lot a charisma because other than the music a really
good DJ that has appeal is what draws the crowds. So
develop a character personality that attracts crowds.
You need to know when to tune it down as well so that
you do not overpower and lose that attention.

As a DJ you have to be knowledgeable in all genre of
music, just knowing a few hit songs here and there won't
cut it. So you need to make sure to brush up on your musical
intellect by learning about all types of music. The way to
learn the music it is to listen to it...even if it is not
what you personally enjoy, a DJ has to know and have a
lot of music.

Now, you need to realize that being knowledgeable in all
music doesn't mean that you will play all music. You
will need to develop your own style as well. You need
to work on a certain niche of music lovers and be able
to entertain with the right music, whether it be rock, rap,
soul or house music.

You need to have good quality music, so if you are downloading
it from the Internet, make sure that you are using legal sites
to get it from so that you are getting the best quality.

Plan on either renting or possibly borrowing the equipment that
you will need until you are comfortable with being a DJ. The
last thing you want to do is spend a lot of money on expensive
equipment and then find you don't enjoy it as much as you thought you would.
Then ask some friends if you can DJ a party of two for them
for free so you can get your feet wet and see how the crowd
reacts.

An important key you need to remember is that you should
base the music you play on the crowd that you are entertaining.
In other words, don't play rap for a group of elderly
people and don't place bluegrass for a bunch of rockers or rappers.

Learning how to DJ can be a lot hard work as well as fun.
So get out there and make your way in the world of music
and don't forget to have fun while you're at it.

Top DJs don't just play the music they become the dance floor, when they move the crowd moves few other professions in the world can make you feel that buzz...do you want it... get the help you need at http://www.startdjing.com

Most piano teachers, if they are serious about what they do, are likely to direct students to purchase or at least be interested in an acoustic piano. However, there are many reasons why an authentic handcrafted instrument might not be your best choice. With portability, convenience, affordability and all the other features a digital piano offers, you might just want to head in the other direction. When it comes to digital versus acoustic, all it basically boils down to is just a matter of genuineness against everything else there is. This is how you can determine which will best suit you in the long run.

Acoustic piano are deficient in many features that you will find in a Digital piano, as the volume control and the convenience of porting your music to your personal computer and many others. The latest version of the Digital piano includes onboard functions such as the electronic metronome as well as mixing features. In comparison to the Acoustic piano, the making of a Digital piano involved the velocity calculating of each key, making this an array of high quality recordings possible. The aesthetic quality of the sound produced is of high quality. An Acoustic piano comprises of a multifaceted assortment of hammers, strings as well as other operational parts which function in association. This simply put, is that when any note is being played, in is not played entirely on its own, instead is affected by the surrounding mechanisms of the piano. As for example, when you play a chord on a Digital piano the outcome would be three notes being played, as though they have been recorded independently, whereas on an Acoustic piano, the three notes would act together with each other and become a stew of ambiance resulting in a more complex and more affluent reverberation. An acoustic piano has no limit of loudness or softness as to when a note is being played; digital pianos have a limited noise level that can be reached, meaning that you would not be able to play a note as loud or as soft as you wish.

Key touch is a vital issue aside from the sound. Digital pianos have been made to feel like their acoustic counterparts. The hammer on the digital has been applied to a graded hammer action, as with the line of hammers on the acoustic which slowly becomes lighter from the left to the right. The digital piano hammers are mainly an annex of the piano players' fingers. The hammers on the acoustic piano on the other hand acts as projectiles which are sprung at the springs.

The general difference in recital between a digital and an acoustic piano would be bleak. What it simmers down to, is the accuracy versus everything else, bear in mind that it is the authenticity that you would be paying for at the end of the day. Depending on your needs and in what route you would want to take your music, the decision in the end would be yours to make. Acoustic or Digital?

You can get a more in-depth knowledge about the piano in general and the many types of digital piano in particular by going to the-piano-site.com - The Complete Online Resource For Pianos And Piano Music.

Customer Review: A must-read for any guitarist looking to take it to the next level
Guthrie Govan proves not only to be an amazing guitarist, but also an excellent teacher. This book will have you feeling inspired to say the least. After reading many of the sections in this book I felt as excited to touch the guitar as I did the first time years ago. Guthrie's love for music and especially the guitar is inspirational. This is by far the best guitar book I have ever read. Not only does it provide excellent technical strategies, but it also gives great insight on how and why certain sounds are produced. The book maintains a light-hearted approach and will not leave you disappointed pick it up if you want to play better.

I can describe the latest release from Jazz super group Weather Report for you with just one word Outstanding!

It's a rare day indeed that I get a CD from an artist that I can truthfully say does not have a bad track in the bunch. I'm more than happy to announce thats exactly what I must say about this one. There simply is NOT a bad one in the bunch. No fillers here at all.

One of the refreshingly nice things about this CD is the way all of the participating artists seem to be really enjoying themselves. Combine that with the overall presentation and youve got one of Weather Report most impressive releases ever.

Overall Mr Gone is excellent from beginning to end. One of those CDs that after a few listens the songs are just etched into your memory. A must have for the Jazz fan. Really sensational from beginning to end.

While this entire CD is outstanding some of my favorites are track 2 - River People, track 3 - Young And Fine, and track 8 - And Then

My Bonus Pick, and the one that got Sore [...as in "Stuck On REpeat"] is track 1 - The Pursuit Of The Woman With The Feathered Hat. Outstanding!

When two middle-aged men tied the knot on March 16, they became the first legally recognised gay couple in Mexico City, the capital of the worlds second largest Catholic country.
    When Mexican gays unite

Journalist Antonio Medina, 38, and economist Jorge Cerpa, 31, registered for homosexual partnership soon after the citys new law permitting gay civil unions took effect, according to the Associated Press.

The Mexicans were united in front of government buildings, kissing under a flag that read "Civil Union Law: Your right to choose" while a band played "Besame Mucho".

"With this law, a history of exclusion comes to an end," Medina told the AP. "Today, the love that before did not dare say its name has now entered the public spotlight.

Last November, Mexico City passed a bill to allow gays and lesbians to form a partnership protecting property, pension and inheritance rights. But it stops short of granting all the legal statues and rights of marriage.

Campaigners had promoted same-sex civil unions for 7 years before the municipal assembly recognized gay couples legal statues, the BBC reported.

"It is simply fantastic," said Julio Roman, a gay rights campaigner in Mexico City. "It is more than symbolic. It is the result of years of fighting for our basic rights."

    Long road ahead

But not everyone is happy. Church officials and Christians reportedly took it to the streets to voice their objections.

"It is simply not the will of God to have acts of homosexuality," Armando Martinez Gomez, president of the Association of Catholic Lawyers, told BBC News.

"We are not against gay people," he noted. "But we believe in a union between a man and a woman for the creation of children."

Church officials have also called the new policy "Hitleria" and the citys politicians faithless, Reuters said.

Mexico City is not the first to take more liberal attitudes toward homosexuals in Latin America. Argentina's capital Buenos Aires, Mexicos northern state of Coahuila and Brazils southern state of Rio Grande do Sul all have legalised same-sex unions.

But the public still remains intolerant of gay couples agitating for legal rights in Mexico, where some 90 percent of its 107 million people are Catholics.

Only 28 per cent of adults support laws that would grant homosexual partners to legal statues and some benefits and rights, according to a poll by Parametra.

In 2005, every two days in Latin America a gay was killed because of his sexuality, reported the Belgium-based NGO International Lesbian and Gay Association.

Countries like Brazil and Mexico have the highest levels of hate crimes, because homosexual people become easy targets when coming out of the closet, said the Economist.
